Impound Auctioneer (a DBA of Next Ride LLC, hereinafter "Impound Auctioneer") operates exclusively as an auction platform and marketplace intermediary. We are not the owner, seller, or transferor of any vehicle listed on this platform. All vehicles are owned by and sold by third-party sellers (impound yards, towing operators, or fleet owners) who list their inventory through our platform.
Impound Auctioneer is not a party to any sale transaction. The sale contract is formed exclusively between the winning bidder (buyer) and the third-party seller. Impound Auctioneer makes no representations, warranties, or guarantees of any kind on behalf of any seller.
Impound Auctioneer does not inspect, verify, or certify any vehicle listed on this platform. All vehicle information, descriptions, photos, mileage, condition disclosures, and documentation are provided by the seller and published in good faith. Impound Auctioneer assumes no responsibility for the accuracy, completeness, or truthfulness of any such information.
All vehicles are sold AS-IS, WHERE-IS, WITH ALL FAULTS, with absolutely no warranties expressed or implied, including but not limited to:
- No warranty of merchantability or fitness for a particular purpose
- No warranty as to mechanical condition, operability, or safety
- No warranty regarding odometer accuracy or actual mileage
- No warranty regarding the existence or absence of liens, encumbrances, or prior damage
- No warranty that the vehicle has not been reported stolen or is not subject to a legal hold
- No warranty regarding compliance with emissions, safety, or registration requirements
All sales are final. No refunds, returns, chargebacks, or cancellations will be accepted under any circumstances after a bid is won. Winning bidders who dispute a charge with their bank or card issuer in connection with a legitimate auction win may be permanently banned and subject to collection action for any amounts owed.
Lot descriptions, photos, odometer readings, and condition information are provided by the seller at the time of listing and are intended as a general reference only. Impound Auctioneer does not independently verify any listing information.
- Photos. Photographs represent the vehicle's condition at the time they were taken and may not reflect current condition. Damage, missing parts, or changes in condition occurring after photos were taken are not the responsibility of Impound Auctioneer.
- Odometer. Odometer readings are reported as shown on the instrument at time of listing. Many impound vehicles are non-running or have unknown mileage history. All odometer readings are provided for informational purposes only and carry no accuracy guarantee.
- Keys. Key status is reported at time of listing. Keys may be lost, missing, or unavailable at time of pickup regardless of what is shown in the listing.
- Condition. Vehicles on this platform are impounded, towed, or fleet vehicles that may have been involved in accidents, subject to environmental exposure, vandalism, or mechanical failure. Buyers should assume all vehicles require inspection and potentially significant repair.
- Hazardous Materials. Impound Auctioneer and the seller are not responsible for hazardous materials, fluids, substances, or environmental contamination associated with any vehicle.
Bidders are strongly encouraged to review all available photos, request additional information from the seller prior to bidding, and bid only on vehicles they have had the opportunity to inspect or are comfortable purchasing sight unseen.
Each lot listing will indicate the type of documentation available with the vehicle. Impound Auctioneer makes no guarantee that any particular documentation will be available at time of pickup beyond what is stated in the listing.
- Clear Title. Some vehicles are sold with a traditional certificate of title. The title is provided as-is and Impound Auctioneer does not guarantee it is free of liens, encumbrances, or prior salvage branding unless specifically stated.
- Bill of Sale Only. Some vehicles are sold with a Bill of Sale in lieu of a title. It is the buyer's sole responsibility to investigate and pursue proper title through the Oklahoma Tax Commission or applicable state agency. Impound Auctioneer makes no representations regarding the ability to obtain title for any vehicle.
- Liens & Encumbrances. Impound Auctioneer does not perform lien searches on any vehicle. Buyers accept full responsibility for any and all existing liens, loans, judgments, or encumbrances on a vehicle regardless of whether they were disclosed.
- Stolen Vehicles. If a vehicle is subsequently discovered to have been reported stolen or subject to a legal hold, Impound Auctioneer's liability is limited solely to a refund of the buyer's premium charged. The vehicle purchase price is a matter between the buyer and the seller exclusively.
Title 42 Assistance (Optional — $150): For Bill of Sale vehicles, Impound Auctioneer offers to submit the Title 42 application to the Oklahoma Tax Commission on the buyer's behalf for a flat fee of $150. This is an optional filing assistance service only. Impound Auctioneer makes no guarantee, representation, or warranty regarding approval or issuance of a title. All title determinations are made exclusively by the Oklahoma Tax Commission. The $150 fee is non-refundable regardless of outcome. The seller provides a Title 42 packet to the buyer at pickup regardless of whether this filing service is elected.
A flat $50 buyer's premium is charged automatically to your saved card each time you win an auction lot. This fee is Impound Auctioneer's service charge and is separate from the vehicle price.
- Only charged on wins. Your card is never charged unless you are confirmed as the winning bidder at auction close.
- Non-refundable. The $50 buyer's premium is non-refundable except in the case of a lot cancellation by Impound Auctioneer prior to vehicle delivery.
- Charged immediately. The charge is processed automatically the moment you are confirmed as winner.
- Multiple wins. A separate $50 buyer's premium applies to each lot won.
- Vehicle payment is cash only at pickup. The winning bid amount is paid to the seller in cash at time of vehicle pickup. Impound Auctioneer does not collect or hold vehicle purchase funds.
- Card required to bid. A valid payment card and a valid U.S. mailing address must be saved on your account before placing any bid.
Full payment of the winning bid is due within 24 hours of auction close. Payment of the vehicle purchase price is made directly to the seller in cash at time of pickup. The $50 buyer's premium is charged to your card by Impound Auctioneer at close.
Failure to pay within 24 hours or failure to appear at pickup constitutes a default. In the event of default, Impound Auctioneer reserves the right to:
- Immediately suspend or permanently ban the buyer's account
- Re-award the vehicle to the next eligible bidder via a second-chance offer
- Retain the $50 buyer's premium as a non-refundable default fee
- Pursue collection of any amounts owed including costs and attorney's fees
- Report the default to the seller and any applicable auction registry
Chargebacks or payment disputes filed against legitimate auction charges are considered default and will result in immediate account suspension and may result in legal action.
Vehicles must be picked up at the seller's designated location (provided after payment) within 3 business days of payment confirmation. Pickup hours and instructions are provided by the seller.
- Location. Pickup address is provided by the seller upon payment. Impound Auctioneer is not responsible for the seller's facility hours, access requirements, or availability.
- Identification. Valid government-issued photo ID is required at pickup. The name on the ID must match the registered account name unless prior written authorization has been submitted to Impound Auctioneer.
- Vehicle condition at pickup. The buyer is responsible for verifying the vehicle condition at time of pickup before taking possession. Once the vehicle leaves the premises, all sales are final and no claims will be accepted.
- Storage fees. Storage fees may be charged by the seller after the 3-business-day grace period. Impound Auctioneer is not responsible for storage charges imposed by the seller.
- Abandonment. Vehicles not retrieved within 14 calendar days of payment confirmation may be considered abandoned and are subject to re-listing, disposal, or lien sale in accordance with applicable Oklahoma statutes. No refund will be issued for abandoned vehicles.
- Transport. Buyers are solely responsible for arranging and paying for vehicle transport. Impound Auctioneer does not provide towing or transport services.
You must be 18 years of age or older and a legal resident of the United States to register and participate. No dealer's license is required — auctions are open to the general public.
Seller and Administrator Accounts. Registered seller accounts and administrator accounts are strictly prohibited from placing bids, submitting offers, or participating in any buying activity on the platform — including on lots listed by other sellers. This restriction applies to all auction formats (timed, buy now, and offers). Attempting to circumvent this restriction will result in immediate account suspension.
The following conduct is strictly prohibited and will result in immediate permanent account suspension and may result in legal action:
- Shill bidding. Placing bids on behalf of the seller or in coordination with the seller to artificially inflate prices.
- Bid manipulation. Any coordinated bidding activity, bid suppression, or collusion among bidders.
- Multiple accounts. Creating more than one account per person for any reason.
- False information. Providing false, inaccurate, or fraudulent registration or payment information.
- Insider bidding. Employees, contractors, and immediate family members of Impound Auctioneer (Next Ride LLC) are prohibited from placing bids on any lot.
- Non-payment. Repeated failure to pay for won lots.
Impound Auctioneer reserves the right to suspend, ban, or limit any account at its sole discretion, with or without notice, for any violation of these Terms or for any conduct deemed harmful to the integrity of the auction platform.
All bids are binding and irrevocable once placed. By placing a bid you are entering into a binding agreement to purchase the vehicle at that price if you are the winning bidder at auction close. Bids placed in error, bids placed without full review of the lot, and bids placed by minors on adult accounts do not constitute grounds for retraction or cancellation.
Impound Auctioneer may, at its sole discretion, consider retraction requests only in cases of documented, verifiable technical failure on the part of Impound Auctioneer's platform. Submission of a retraction request does not guarantee approval.
Any bid placed within the final 1 minute of a timed auction will automatically extend the auction timer to 1 minute from the time of that bid. This process repeats for each qualifying bid. This rule applies equally to all bidders including proxy (auto-bid) bids triggered by the system. Impound Auctioneer reserves the right to modify auction timing rules at any time.
Impound Auctioneer reserves the right to cancel, remove, postpone, or re-list any lot at any time, before or after auction close, without notice or obligation to bidders. Grounds include but are not limited to: title defects, discovered liens, vehicle damage or theft, legal holds, court orders, seller withdrawal, erroneous listing information, or any other reason at Impound Auctioneer's sole discretion.
In the event of cancellation before auction close: no charges are assessed and all bids are void.
In the event of cancellation after auction close but before vehicle delivery: the $50 buyer's premium will be refunded within 3–5 business days. Impound Auctioneer's total liability in such cases is limited solely to the refund of the buyer's premium charged. No additional compensation, consequential damages, or expenses incurred by the buyer will be reimbursed.
You agree to indemnify, defend, and hold harmless Impound Auctioneer (Next Ride LLC), its officers, directors, employees, agents, and successors from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorney's fees) arising out of or related to:
- Your use of the platform or participation in any auction
- Your purchase, possession, operation, or transfer of any vehicle acquired through this platform
- Your violation of these Terms or any applicable law or regulation
- Any injury, property damage, or loss caused by any vehicle acquired through this platform
- Any third-party claims arising from your use of any vehicle purchased hereunder
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IMPOUND AUCTIONEER (NEXT RIDE LLC) SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DAMAGES FOR:
- Vehicle condition, defects, mechanical failure, or fitness
- Loss of use, lost profits, or economic loss
- Errors or omissions in lot descriptions, photos, or information
- Title defects, liens, encumbrances, or inability to register a vehicle
- Platform downtime, technical failures, or auction errors
- Actions or omissions of any third-party seller
In all cases, Impound Auctioneer's maximum total liability to any party shall not exceed the total fees paid to Impound Auctioneer in connection with the specific transaction giving rise to the claim. This limitation applies regardless of the basis of the claim (contract, tort, statute, or otherwise) and even if Impound Auctioneer has been advised of the possibility of such damages.
These Terms are governed by the laws of the State of Oklahoma without regard to conflict of law provisions. Any dispute, claim, or controversy arising out of or relating to these Terms or your participation in any auction shall be resolved as follows:
- Informal Resolution. Before filing any legal action, you agree to contact Impound Auctioneer at admin@impoundauctioneer.com and attempt to resolve the dispute informally for a period of at least 30 days.
- Binding Arbitration. If informal resolution fails, disputes shall be resolved by binding arbitration administered in Oklahoma County, Oklahoma in accordance with the rules of the American Arbitration Association (AAA). Each party bears its own costs unless the arbitrator awards otherwise.
- Class Action Waiver. You waive any right to bring claims as a class action, collective action, or representative proceeding. All disputes must be brought in your individual capacity only.
- Exception. Impound Auctioneer may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent unauthorized use of the platform or protect its intellectual property.
